1. Acceptance of Terms
By accessing or using CuraVita ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including wellness customers and clinical program patients.
2. Platform Description
CuraVita provides an online wellness commerce platform for OTC supplement purchases and a telehealth coordination service. CuraVita does not employ licensed healthcare providers. Clinical services are delivered by independent licensed providers through Wheel Health, a third-party provider network. CuraVita is the technology platform; it is not a medical practice.
3. Medical Disclaimer
CuraVita does not provide medical advice. Content on the Platform is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of content on the Platform.
For clinical telehealth services, prescriptions are issued solely at the discretion of independent licensed providers. No prescription is guaranteed.
4. Eligibility
You must be at least 18 years of age to use this Platform. By using the Platform, you represent that you are 18 or older. Clinical programs have additional eligibility requirements assessed during intake.
5. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify CuraVita immediately of any unauthorized use of your account. CuraVita is not liable for any loss arising from unauthorized use of your account.
6. Supplement Products
OTC supplement products are sold as-is. These statements have not been evaluated by the Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease. Individual results may vary. See our Refund Policy for return and refund terms.
7. Clinical Services and Payments
Clinical program subscription fees are charged at enrollment. If a licensed provider declines to prescribe after reviewing your intake, you will receive a full automatic refund within 5 business days. Once a prescription has been approved and dispensed, the clinical program fee is non-refundable for that billing period.
8. Prohibited Uses
You may not: (a) provide false medical information; (b) share prescription medications; (c) use the Platform for any illegal purpose; (d) attempt to obtain prescription medications without completing a legitimate clinical intake; (e) circumvent security measures.
9. Limitation of Liability
To the fullest extent permitted by law, CuraVita Health Technologies, Inc. shall not be liable for indirect, incidental, special, or consequential damages. CuraVita's total liability for any claim shall not exceed the amount paid by you to CuraVita in the 12 months preceding the claim.
10. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration pursuant to the AAA Consumer Arbitration Rules.
